Terms of Use

The rules for using Shibui, including plans, credits, one-off template purchases, license, cancellation, refunds and responsibilities.

These Terms govern the use of Shibui (the shibui.build site, site editor, template gallery and published sites), provided by SUMIOSHI LABS, Brazilian company registration (CNPJ) 63.515.130/0001-87 ("Shibui", "we"). By creating an account, buying a template or using the service, you ("user") agree to these Terms and to the Privacy Policy.

1. The service

Shibui lets you create websites with artificial intelligence from templates or from a description, edit the content by chat, publish the site at a your-name.shibui.build address and buy one-off templates. The features of each plan are described on the pricing page, which is part of these Terms.

2. Account

  • You must be 18 or older and provide accurate information.
  • You are responsible for the security of your access and for everything done in your account.
  • We may suspend or close accounts that violate these Terms, with notice whenever possible.

3. Plans, credits and trial

  • Paid plans are subscriptions charged on a recurring basis (monthly or yearly, as chosen) until cancelled.
  • AI actions consume credits. The number of credits in each plan and the cost of each action are shown on the pricing page. Unused credits do not roll over to the next cycle and cannot be exchanged for money.
  • When a trial is offered, its conditions (length, trial credits and whether a card is required) are shown before you sign up. If you do not cancel before the trial ends, the subscription starts and the first charge is made.
  • We may change prices and plans. Price changes apply from the next cycle and will be announced in advance.

4. One-off template purchases

  • A one-off template is paid once, by Pix or card, with no subscription. You can buy without an account: access is sent to the email given at checkout.
  • After payment is confirmed, you can download the template file and use it in the editor, under the license in section 5.
  • Site packs (such as the 27 Sites Pack) follow the same rules: each site in the pack is a template under the license in section 5.
  • Templates and packs are digital content delivered instantly. Before paying, you confirm that you have read and accept these Terms; we store the date, the text version and the IP address of that acceptance.
  • Every downloaded file carries a license code that identifies the purchase (no visible personal data). We log the date and IP of each download, and each template can be downloaded up to 3 times per purchase; contact us if you need more.

5. Template license

When you buy a template, you receive a commercial, perpetual, non-exclusive and non-transferable license to:

  • use the template on your own sites or on sites for your clients, in as many projects as you want;
  • freely modify the code, text and images.

You may not resell, redistribute, sublicense or make the template available, modified or not, as a template or as part of a template pack, library or marketplace. Rights to the original template remain with Shibui.

6. User content and AI-generated content

  • The content you upload and the sites you create are yours. You authorize us to store, process (including through AI providers) and display them only to operate the service, such as publishing your site.
  • You are solely responsible for the content of your sites, including text, images, prices, offers and forms, and for complying with the laws that apply to your business (including consumer protection and data protection towards your site's visitors).
  • AI-generated content may contain errors or resemble third-party content. Review everything before publishing.

7. Prohibited use

You may not use Shibui to:

  • publish illegal, misleading, defamatory or discriminatory content, or content that infringes third-party rights (including trademarks and copyright);
  • run phishing, scams, collect passwords or payment data under false pretenses, or create sites that impersonate another person or company;
  • send spam, distribute malware or attack any system;
  • bypass credit, project or access limits, or extract the template library through automated means.

We may take down, without prior notice, sites that break these rules.

8. Cancellation and refunds

  • You can cancel your subscription at any time from your account. Access continues until the end of the period already paid, with no cancellation fee.
  • Right of withdrawal: purchases made online can be cancelled within 7 days of purchase for a full refund, as provided by article 49 of the Brazilian Consumer Protection Code. To request it, use the form at shibui.build/contact.
  • For one-off templates or packs, a refund cancels the license in section 5, and downloaded templates may no longer be used.
  • Refund requests after download and card chargebacks may lead to blocking of future purchases on Shibui. In chargebacks, we use the acceptance and download records as proof of delivery.
  • Outside the withdrawal period, there are no pro-rata refunds for periods already started, except for service failures attributable to us or where the law requires it.

9. Published sites and availability

  • Published sites stay online while your account and plan allow publishing. If your plan ends, the site may go offline; you can export the project when your plan includes that feature.
  • On plans that show branding, the published site includes the "Made with Shibui" badge.
  • We aim to keep the service available at all times, but interruptions may happen for maintenance or due to third-party failures. We do not guarantee uninterrupted availability.

10. Liability

  • Shibui is provided as is. We do not guarantee business results, search engine rankings or sales from the sites created.
  • To the maximum extent permitted by law, our total liability for damages related to the service is limited to the amount you paid Shibui in the 12 months before the event. This limit does not apply where the law, including consumer protection law, forbids it.

11. Changes to these Terms

We may update these Terms. The date at the top shows the version in force. Relevant changes will be announced in advance by email or on the site; continuing to use the service afterwards means you accept the new version.

12. Governing law and venue

These Terms are governed by the laws of Brazil. Disputes will be heard in the courts of the consumer's domicile; in other cases, in the courts of SUMIOSHI LABS's registered office.
